1. Agreement and eligibility
By creating an account, accepting an invitation, or using Alabaster CRM, you agree to these Terms. If you use the service for an organization, you represent that you are authorized to bind that organization. You must be at least 18 years old and legally able to enter a contract.
2. Accounts, tenants, and invitations
Customers control who may access their tenant and which roles and permissions those users receive. You must provide accurate account information, keep credentials confidential, use multi-factor authentication when required, and promptly report suspected unauthorized access. You are responsible for activity performed through your account unless caused by Alabaster's breach of these Terms.
3. Customer data and connected accounts
Customers retain their rights in information and content submitted to Alabaster CRM. The customer grants Alabaster Store LLC the limited rights necessary to host, process, transmit, display, and back up that information to provide and secure the service. You represent that you have the notices, permissions, consents, and lawful basis needed to collect and use customer data and to connect third-party accounts.
4. Communications and social publishing
You are responsible for messages, calls, emails, social content, and automated communications sent through your tenant. You must comply with applicable privacy, marketing, telemarketing, anti-spam, recording-consent, intellectual-property, and platform rules. Connecting a provider does not guarantee that the provider will approve, deliver, or display a communication. Provider limits, review requirements, messaging windows, rate limits, account status, and outages may affect availability.
5. Acceptable use
You may not use Alabaster CRM to:
- Break the law, violate another person's rights, or send unlawful or deceptive communications.
- Upload malware, probe or bypass security controls, disrupt the service, or access another tenant without authorization.
- Misrepresent identity, impersonate others, or obtain provider permissions through deceptive means.
- Resell, reverse engineer, scrape, or copy the service except where applicable law expressly allows it.
- Store highly sensitive data when the service has not expressly been configured and contracted for that purpose.
6. Third-party services
Alabaster CRM may interoperate with services such as Meta, Google, communications providers, payment processors, and hosting providers. Your use of those services remains subject to their terms and policies. We are not responsible for third-party changes, suspensions, outages, or decisions outside our control, but we will use reasonable efforts to operate our integration correctly.
You may access provider data only for the tenant and accounts you are authorized to manage. You may not use Alabaster to sell provider data, create unauthorized profiles, circumvent platform review or permission limits, or retain connected-account data after you no longer have a lawful business need or authorization to use it.
7. Fees, changes, and suspension
Paid features, prices, billing periods, taxes, usage limits, renewal terms, and cancellation rights will be shown in the applicable order or subscription screen. We may suspend access when reasonably necessary to address nonpayment, security threats, unlawful use, material violations, or provider requirements. Where practical, we will provide notice and an opportunity to cure.
8. Termination and data export
A customer may stop using the service and request account closure. Upon termination, access may end and customer data may be deleted after any applicable export or retention period, subject to legal, security, backup, and dispute-resolution requirements. Integration access can be revoked from Alabaster or the connected provider.
9. Service terms and disclaimers
We will provide the service with reasonable care and work to maintain its availability and security. Unless prohibited by law or stated in a separate signed agreement, the service is provided “as is” and “as available,” and we disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
10. Limitation of liability
To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, revenue, goodwill, or data. Alabaster Store LLC's aggregate liability arising from the service will not exceed the amount the customer paid Alabaster for the service during the twelve months before the event giving rise to the claim. These limits do not apply where they are prohibited by law.
11. Governing law and changes
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law rules. Courts located in Gwinnett County, Georgia will have exclusive jurisdiction unless applicable law requires otherwise. We may update these Terms and will provide notice of material changes when appropriate. Continued use after the effective date constitutes acceptance of the updated Terms.
